Umweltpaket und umweltpolitischer Gestaltungsspielraum

Abstract

Die Beitrittsverhandlungen haben in bezug auf den Umweltschutz ein neues Signal gesetzt. Im Beitrittsvertrag erkennt die EU explizit die höheren Umweltstandards Österreichs und auch der anderen Beitrittswerber an und kommt dem Wunsch, das höhere Schutzniveau beizubehalten durch Übergangsfristen entgegen. Die EU ist darüber hinaus bereit, ihre eigenen Regelungen zu überprüfen und nach Möglichkeit an das höhere Schutzniveau anzugleichen. Ein Rechtsanspruch auf die Angleichung läßt sich daraus aber nicht ableiten. Es gibt jedoch auch umweltrelevante Bereiche, in denen die EU-Gesetzgebung weiter fortgeschritten ist als in Österreich. Dazu zählen etwa die gemeinschaftliche Immissionsschutzregelung und das Öko-Audit. Neben den Verhandlungspunkten im Umweltpaket kommt dem autonomen Handlungsspielraum eines Landes im Rahmen der Umweltschutzgesetzgebung der EU sowie der Einflußnahme auf gemeinschaftliche Umweltschutzregelungen ein wichtiger Stellenwert zu.
