Driving Forces in the Juridical Regulation of the Agricultural Firm

Abstract

In Italy, the issues related to the legal rules of the agricultural firm remained for a long time within the borders established by the definition contained in the civil code of 1942 and by special statutes. Recently, three relevant driving forces are redefining goals, borders and rules of agricultural business: - the European law; - a new, and more reform-oriented national attitude; - the emerging tendency in favourof local business rules , as regulation on a contractual basis and at the same time as regulations in troduced by the Regions . In this framework, a possible identity of agriculture, and specifically of agricultural business, may be found within the Constitution, through the rules of art. 44, which favours an agriculture able to unify in ?the rational use of the land¨ both efficient and sustainable production methods, and the recent reforms regarding competition, federalism and subsidiarity.
