Abstract

Einige Breitenerhebungen und Fallstudien haben grundlegende Erkenntnisse ueber Formen, Funktionen und Entstehungskontexte kollektiver Interessenvertretungsorgane auf Betriebsebene, die keine Betriebsraete sind und oftmals als ‚Andere Vertretungsorgane’ (AVOs) bezeichnet werden, generiert. Der vorliegende Beitrag moechte zur Debatte beitragen, indem dezidiert Unterschiede in den Partizipationsmustern verschiedener AVO-Typen untersucht werden. Auf diese Weise soll ein genaueres Verstaendnis divergenter ‚Logiken‘ kollektiver Interessenvertretung ermoeglicht werden. Ausgangspunkt ist eine Typologie unterschiedlicher Funktionen von AVOs: Der erste Typ umfasst von der Geschaeftsleitung initiierte ‚Instrumente im Leistungsprozess’, die auf die Steigerung der betrieblichen Effizienz abzielen. Der zweite Typus wird als ‚Beteiligungsorgan’ tituliert, in dessen Zentrum die Interessenvertretung der abhaengig Beschaeftigten steht. Es wird argumentiert, dass die Interessenvertretungschancen von AVOs wesentlich mit dem AVO-Typus, der Kultur der Austauschbeziehungen und den Haltungen und Strategien der beteiligten Akteure variieren. Waehrend die ‚Instrumente im Leistungsprozess’ hinsichtlich ihrer Beteiligungspraxis einer Logik von durch die Geschaeftsleitung ‚angeordneter Partizipation’ folgen, handelt es sich bei den ‚Beteiligungsorganen’ um (von den Beschaeftigten) ‚erkaempfte’ bzw. (von der Geschaeftsleitung) ‚tolerierte’ Partizipation. (Surveys and case studies have provided a basic understanding of patterns, functions and context conditions of collective employee representation bodies at firm level in Germany which are not works councils, but non-statutory forms of employee representation (NSRs). This paper aims to contribute to the literature by analyzing differences in the participation patterns of different NSR-types. The starting point is a typology of different functions of NSRs: The first type comprises management-initiated ‘personnel management instruments’ aimed at increasing operational efficiency. The second type is called ‘participation bodies’, which represent the interests of employees. It is argued that the influence opportunities of NSRs vary significantly depending on NSR type, company culture, and attitudes and strategies of key the actors involved. While ‘personnel management instruments’ follow a logic of ‘mandatory participation’, ‘participation bodies’ are characterized by participation which has been ‘hard won’ by employees and is ‘tolerated’ by management.)
