    Abstract

    L’étude des corrélations entre règles juridiques d’hier et d’aujourd’hui et types de paysage reste à faire. Toutefois, le couple « droit et paysage » peut susciter une réflexion plus théorique de la part des juristes. Dans un premier temps, nous examinerons la question de la définition juridique du paysage, puis celle de sa qualification juridique, question délicate car la catégorie juridique « patrimoine commun » n’est guère satisfaisante. Dans un second temps, seront évaluées les tensions internes qui se manifestent dans le droit du paysage. Appropriation privée, appropriation publique et appropriation collective sont en effet susceptibles de s’exprimer dans un même espace. Nous verrons comment, en droit français, est juridiquement pris en compte le désir d’appropriation collective du paysage mis en exergue par le Conseil de l’Europe dans sa Convention européenne du Paysage
