L’exclusion bancaire et le traitement du surendettement

Abstract

[eng] Banking exclusion and dealing with excessive indebtedness . Withdrawal of a cheque book feels like a much harsher sanction than the fact of no longer being able to obtain credit. The max of 29 july 1998 relating to the fight against exclusion certainly took this problem into account, but the provisions made were only aimed at people in a state of almost total insolvency, which is hardlylikely to encourage their banker to take the risk of entrusting then with a new cheque book. The basic bankingservice which it introduced can only be imposed for clients having asked the bank of France to designate a bank. . JEL Classification : G21, G28, I30 . . [fre] Le retrait du chéquier est vécu comme une sanction beaucoup plus pénalisante que le fait de ne plus pouvoir bénéficier d’un crédit. La loi du 29 juillet 1998 relative à la lutte contre l’exclusion a bien pris en compte ce problème mais les dispositions prises ne visent que les personnes en situation de quasi totale insolvabilité, ce qui n’est a priori pas de nature à inciter leur banquier à prendre le risque de leur confier à nouveau un chéquier, et le service bancaire de base qu’elle instaure ne pourrait être imposé qu’au bénéfice des clients ayant demandé à la banque de France de procéder à la désignation d’un établissement financier. Le nombre de saisines des commissions de surendettement, tout comme le nombre de notification d’interdits de chéquiers ne cessant de croître, il y a maintenant urgence à généraliser un vrai service bancaire de base, garantissant pour tous un niveau de prestations suffisant. .
