Abstract

[eng] From the analysis of changes intervened in the field on Intellectual Property Rights during the last 20 years in United States, the article puts highlights the « imperial dimension » of this right. This thesis is established by recalling the relations existing between some provisions of the Bayh-Dole Act (section 204 nota-bly) which associate transfer of « exclusive licenses » and « preference for the American industry » on one hand and some of the changes introduced in the Trade Act (the section 301, notably) on the other hand... An illustration in the way these legal resources are used to impose at the world level the new American IP right, is given, in the case of Semiconductors. [fre] À partir de l'analyse des changements intervenus dans le droit de la PI au cours des 20 dernières années aux États Unis, l'article met en évidence la « dimension impériale » de ce droit. La thèse est établie en mettant en rapport certaines dépositions du Bayh-Dole Act (section 204 notamment) qui associent cession de « licences exclusives » et « préférence pour l'industrie américaine » d'une part et certaines dispositions du Trade Act (la section 301, notamment) d'autre part. Une illustration de la manière dont ces ressources juridiques sont utilisées pour imposer au niveau mondial le droit américain, est donnée dans le cas du droit des semi-conducteurs.
