La remise en cause du droit d'auteur sur internet : de l'illusion technologique à l'émergence de barrières à l'entrée

Abstract

[fre] L'avènement des technologies et des réseaux numériques est l'occasion d'une contestation forte du principe et de la mise en œuvre du droit d'auteur. Les discussions ont lieu en grande partie entre juristes et théoriciens de la communication, mais s'étendent également aux économistes. Les critiques les plus nouvelles affirment que les technologies numériques, si elles remettent en cause le droit d'auteur, permettent parallèlement de lui substituer de nouvelles formes de protection des contenus basées sur un modèle contractuel et non plus réglementaire. Les limites de cette substitution contractuelle et technologique apparaissent cependant rapidement. Les technologies de protection de contenus représentent surtout une nouvelle arme concurrentielle aux mains de certains producteurs de contenus. De surcroît, que les TIC soient utilisées pour renforcer le droit d'auteur ou qu'elles permettent de le remplacer par le droit du contrat, elles donneront lieu à des problèmes importants de standards et de compatibilité. [eng] Nowadays, digital technologies and the Internet give rise to important daims against copyright law. ICTs are thought not only to challenge the very foundation of copyright but also to supply content providers with more efficient protection methods to appropriate revenue from users. According to economic literature, this technological devices called 'self-help systems' would enable the emergence of a contractual law paradigm that would substitute for the current obsolete regulation. By contrast, our paper suggests that this technological and contractual substitution proves to be ineffective. In fact, self-help systems are far from being neutral but they become new competitive arms that are not within reach of every content producer. Moreover, whether ICTs serve to reinforce copyright or replace it with contract law, they give rise to issues of standards and compatibility.
