Crime et châtiments dans l'Espagne inquisitoriale. Essai de typologie délictive et punitive sous le dernier Habsbourg et le premier Bourbon

Abstract

[fre] Résumé Nous évoquons ici la genèse d'une recherche menée - dans le cadre de la Thèse de Doctorat d'Etat - à travers les Archives Secrètes du Tribunal d'Inquisition d'Espagne, et quelle fut, pour ce faire, notre démarche scientifique et personnelle. Partant de l'étude sérielle d'une compilation de relations manuscrites d'autodafés particuliers, célébrés entre 1660-1730 par les tribunaux castillans, nous avons mesuré les proportions relatives des délits représentés, le rapport précis entre la faute jugée et le châtiment infligé. Nous avons, par ailleurs, grâce aux nombreuses et précieuses données de ces fiches signalétiques, retracé le profil socio-professionnel et personnel des condamnés, en privilégiant le groupe des crypto-judaïsants, qui représentent plus de 70% de l'ensemble. Une importante documentation annexe, notamment la correspondance des tribunaux et les procès conservés, nous a permis de reconstituer l'expérience vécue par le condamné en amant et en aval du procès de foi, de saisir le poids de ce «vécu inquisitorial» dans le destin individuel. [eng] Abstract Evoqued here, is the genesis of a research project conducted within the context of a doctoral thesis, using the secret Archives of the Spanish Inquisitorial Tribunals and our applied scientific method and personal approach. Following the serial study of a compilation of handwritten accounts of «autos de íe particulares» held between 1660 and 1730 by the Castilian Tribunals, we have divided and classified by proportional percentages the crimes represented and the exact relationship between a given punishment and a given crime. Furthermore, thanks to a large number of valuable data taken from information sheets, we have been able to retrace the socio-professional and personal profile of the convicted, with particular importance placed on the Crypto-judaizers, this group representing over 70% of the whole. The wealth of annex documents, particularly the tribunal's correspondences and preserved trial records, has permitted us to piece together what the convicted went through before and after the trials of faith and to determine the impact of the inquisitorial experience upon the individual's existence.
