Pour assurer le respect de la légalité dans l’activité de l’administration on peut recourir au contrôle juridictionnel déroulé soit par voie directe de l’action en annulation des actes administratifs illégaux, soit par voie indirecte de l’exception de non légalité ayant comme objet l’acte administratif. On peut appliquer une règle juridique dans la mesure où elle existe et elle est conforme aux actes normatifs, hiérarchiquement supérieurs.
