Quelques questions de droit dans la matière du contentieux administratif

Abstract

Une analyse de la pratique judiciaire de la Roumanie au cours des dernieres années, relevera, entre autres, le fait qu'un certain nombre de problemes de droit ont reçu une solution différente, et parfois même contraire. L'un des aspects qui sont a la base d’une telle pratique non unitaire est aussi la possibilité d'interpréter de façon différente certains textes normatifs que le juge est tenu d’appliquer dans des cas concrets déduits de son jugement. Dans cette étude, sera faite une présentation seulement de trois prévisions légales qui ont généré de telles situations, leur analyse étant faite dans le cadre concret d'une des causes.
