Abstract

La conscience juridique international est profondément marquée par une culture de la protection des droits de l’homme, des droits fondamentaux et cette protection se trouve au cœur du concept politique de « pré - éminence du droit » (Rule of Law). Pourquoi est-il nécessaire d'étudier en détail le systeme national, européen ou international de protection des droits naturels, surtout des droits de l’homme? Autour ces modeles de systemes de protection se développe en grande mesure la vie juridique interne et internationale. La protection et garantie des droits subjectifs naturels représente un sunet de maxime résonance dans la pensée juridique, mais aussi de résistance maxime devant le positivisme juridique
