The appeal to the preliminary judgment on the rejection of unconstitutional defense

Abstract

La clôture de séance est l’unique acte juridique procédural par lequel on peut investir la Cour Constitutionnelle avec une exception de non constitutionalité. La clôture de séance produit les effets dont on a parlé seulement si elle est la conséquence de l’activité, soit des instances de jugement, sans tenir compte de leur nature (civile, militaire) et de l’étape dans laquelle se trouve le procès (sur fond, appel, contestation en annulation, demande de réexaminassions), soit d’une instance d’arbitrage commerciale, en éliminant toute autre instance d’arbitrage qui juge d’autres demandes de nature patrimoniale.
