The Legal Settlement of Utilities and Their Privatization in Romania

Abstract

Public administration represents that special state activity that is neither law nor justice. Through public administration state achieve its goals, respecting legal regulations. Utility is a general interest activity, made by public administration, whose mission is to satisfy the general interest. Taking about constitutional basement we can declare that our constitutional text work in modern constitutional markscale. The constitutional text contains expressly or implicitly regulations about utilities. Utilities have a special juridical schedule – called administrative schedule. Their organization and administration is made after special principles, characteristic for public law. Utilities are essential for society because they are instrumental device, that assure a certain level of welfare to the citizen.
