Antitrust law and judicial review

Abstract

In this article new trends in judicial review of antitrust decisions are explored, focusingspecifically on the relation between antitrust law and regulation, and on cases of(alleged) abuse of judicial process and abuse of administrative procedures. The differencebetween approaches prevailing in the Usa and in the Ue and in Italy is alsoanalysed, to show the different consequences on the rule of law and on internal andexternal limits to antitrust enforcement.
