Abstract

L'avvento dell'era digitale ha sconvolto l'orizzonte di riferimento determinando l'emergere di nuovi beni e servizi, nuovi soggetti, nuovi diritti ma anche di nuove forme di sfruttamento e di minaccia dei diritti preesistenti generando un acceso dibattito sull'adeguatezza degli attuali sistemi di tutela dei diritti rispetto agli sviluppi tecnologici. Ultima testimonianza in proposito è fornita dall'ampia mobilitazione promossa sullo scenario nazionale contro il presunto tentativo di controllo e censura della libera circolazione delle informazioni via web rappresentato dalla proposta di «Regolamento in materia di tutela del diritto d'autore sulle reti di comunicazione elettronica» elaborata dall'Autorità per le garanzie nelle comunicazioni: quello che è nato come un intervento regolamentare per combattere la pirateria online si è tramutato, negli occhi dei contestatori, in un provvedimento liberticida in grado di minacciare la libertà di espressione in rete.
