    Abstract

    Il contributo rilegge criticamente il rapporto tra presidio pubblico della concorrenza e azioni di danno promosse dalle vittime di illeciti antitrust. L'impostazione tradizionale assumeva che il compito di arginare deviazioni monopolistiche corrispondesse a un interesse pubblico e dovesse, di conseguenza, essere affidato al controllo pubblicistico. In questo quadro, l'iniziativa del privato intesa a ottenere ristoro per il pregiudizio subito rimaneva al margine del quadro complessivo, anche perché penalizzata da una cospicua serie di ostacoli tecnici.. Le analisi teoriche tendono tuttavia - non senza qualche resistenza - a dimostrare che il public enforcement è insufficiente nella prospettiva di un'efficace deterrenza delle distorsioni anticompetitive. Di qui il faticoso tentativo, rimasto sin qui quasi incoato, di incentivare il versante privato: traiettoria resa vieppiù complicata dall'irrisolta opzione di base tra la creazione di regole settoriali e il ricorso, che sembra ora prevalere, a più complessi interventi di sistema.
