European Commission vs. MasterCard: Antitrust Analysis of a Two-sided Market

Abstract

Lo scorso dicembre la Commissione Europea ha concluso l'indagine sulla commissione interbancaria di default del circuito MasterCard, stabilendo che essa rappresenta un'intesa sul prezzo, produttiva di restrizioni della concorrenza, peraltro non accompagnate da comprovate efficienze. Si tratta di una decisione in netta controtendenza rispetto agli orientamenti delle autorità antitrust di tutto il mondo che, da decenni, sottopongono a continuo scrutinio il mercato delle carte di pagamento. Il presente lavoro offre una lettura critica della Provisional Non Confidential Version della Decisione, di recente pubblicazione. Essa è per certi versi oscura, per altri discutibile, ma soprattutto sconta un peccato originale, ovvero il rifiuto di adottare un approccio olistico nella comprensione del ruolo della commissione interbancaria, l'unico in grado di rendere un'immagine completa e veritiera di un mercato bilaterale come è quello delle carte di pagamento.
