The Influence of European Union Law and of International Law on the Development of National Legislation

Abstract

The relatively large amount of laws developed by the institutions of the European Union, their supremacy over national laws, the priority of international conventional law and the consequences that result therefrom on national legal systems represent only a few of the elements which have determined us to reflect in the present article on the constraining manner in which community and international law influence the development of national legislation. Obviously we express a point of view without attempting to slander the European construction or to deny its benefits, especially that the report between the two juridical orders finds its basis in the Constitution, and the union of the national legislation with the European one wishes to be accomplished respecting the democratic demandings.
