Report of Debts According to Law No. 287/2009 on the Civil Code

Abstract

Law No. 287/2009 on the Civil Code3 confers a new configuration to the field of successions in general. In the short time which elapsed from the moment the normative act in question entered in force, only 4 specialized works4 were written in the field. Consequently, the analysis of hereditary law institutions is both useful and actual. Under these circumstances, the present work aims to analyze all the aspects involved by the report of debts in the light of the new Civil Code. Thus, there will be analyzed the following aspects: definition, legal regulation, conditions, legal effects and legal nature of the report of debts. All these issues shall be approached in a comparative manner, by taking into account the 1864 Civil Code and the new Civil Code. Thus, we will be able to point out in a clear manner the novelties brought in the field subject to our analysis by Law No. 287/2009 and to assess their just and appropriate character.
