The Election Offences in Regulating the Legislation of the Republic of Moldova [Infractiunile electorale in reglementarea legislatiei Republicii Moldova]

Abstract

In this article are analyzed the four election offences referred to in articles 181, 1811 and 182 Penal Code of the Republic of Moldova. It is revealed that art.181, 1811 and 182 PC RM carry similarities with art.385-387 and par.(1) art.391 Penal Code of Romania from 17.07.2009. It is established that the purpose of the respective articles is to defend - by excellence or mainly - the social relations with regard to the achievement, in accordance with art.38 of the Constitution of the Republic of Moldova, of the right to vote and to be elected. It is shown that the offences referred to in these articles are committed with intention, direct or indirect one. It is demonstrated that a special quality for the subjects of the offences provided by art.181 and 1811 PC RM is unnecessary and the subjects of the two offences under art.182 PC RM are special subjects.
