Az elváltak gazdasági körülményei az Egyesült Államokban

Abstract

Az angolszász országokban, részben azért is, mert a családjogi bírósági tárgyalásokat in camera, vagyis nem nyilvános formában tartják, nem publikálják a meghozott határozatok összesített adatait. (Az Egyesült Államokban a családjogi ügyeket mindjárt állami szinten, vagyis a superior courtokban, nem pedig a magistrate courtokban tárgyalják.) Így nem hozzáférhetők adatok arra vonatkozóan, hogy egy-egy évben hány ügy került, és hány nem került a bíróság elé (mert peren kívül rendeződött); hány ügyben kellett a gyermek(ek) elhelyezéséről, anyagi támogatásáról dönteni, és milyen összeget szabott ki, milyen vagyonmegosztási egyezséget hagyott jóvá a bíróság, nem ismeretesek a peres felek gazdasági-társadalmi körülményei, hány ügy került ismételten a bíróság elé stb. Az adatok tekintetében tehát kizárólag társadalomtudományi kutatásokban felmért minták megoszlási adataira lehet hagyatkozni.
