Abstract

Il dialogo competitivo quale nuovo istituto del partenariato pubblico privato (di Annalisa Damele) - ABSTRACT: Il dialogo competitivo ? una nuova procedura di scelta del contraente caratterizzata dal coinvolgimento dei privati nell'individuazione della soluzione tecnico economica per la realizzazione di un'opera per l'acquisizione di un servizio o di una fornitura. Si tratta di un sistema di gara introdotto dal diritto comunitario, connotato da una notevole flessibilit? applicabile ai contratti particolarmente complessi. La cooperazione che viene a instaurarsi tra il soggetto pubblico e quello privato consente di annoverare il dialogo competitivo tra i partenariati pubblico privati.
