Abstract

Il gruppo di studio sul Codice Civile Europeo ed i suoi oggetti (di Christian von Bar) - ABSTRACT: In questo scritto vengono riassunte, in maniera sintetica quanto precisa, le linee di fondo del gruppo di studio sul Codice civile europeo. Von Bar spiega come nessuno nutra l?ambizione di sradicare l?impianto giuridico di ciascun paese europeo; invero, la speranza ? quella di creare un patrimonio comune sul quale fondare la nuova civilt? (non solo giuridica) europea. In tal senso, l?Autore evidenzia come gli attuali strumenti di ravvicinamento delle legislazioni (trattati e direttive) siano insufficienti ad assicurare efficacemente la nascita di un humus giuridico europeo ed, esortando a tentare la via del codice, invita a fare piuttosto che a criticare.
