Il punto sui servizi pubblici locali dopo gli interventi legislativi del 2011 e 2012

Abstract

In seguito all?abrogazione referendaria dell?art. 23-bis, si ? giunti attraverso pi? interventi legislativi (ultima la legge 27/2012) ad introdurre un sistema normativo pressoch? completo, che riguarda in generale i servizi pubblici locali a rilevanza economica, e comprende settori prima esclusi, i trasporti regionali anche per ferrovia, e i trasporti locali metropolitani e su gomma. L?impostazione fondamentale richiede agli enti locali competenti a decidere le modalit? di gestione, di valutare prima di tutto, una volta individuati gli obblighi di servizio pubblico da garantire per ciascuna attivit?, la possibilit? di liberalizzare il servizio ammettendone l?erogazione da parte di una pluralit? di soggetti. Soltanto ove questo non sia possibile si affider? in esclusiva il servizio tassativamente mediante una gara.
