La Labor Del Juez De Ejecución En Cuba Y Su Impacto En La Resocialización Del Delincuente

Abstract

Desde hace siglos los autores clásicos cuestionan si el fin de la pena, es solo la represalia por el daño o es una actividad altruista de intentar corregir la conducta nociva del “delincuente”, valorándose incluso la tesis deque es la propia sociedad la culpable de los actos nocivos de sus integrantes. Basándose en estas dudas se desprende el tema de la efectividad de la privación de libertad; de la cual se ha demostrado su escasa efectividad en la reeducación del reo, tomando fuerza las penas ambulatorias, las que naturalmente conllevan a la institución de un sistema encargado del control de la ejecución de las mismas. En Cuba durante mucho tiempo esta labor estuvo al cargo de la PNR, pero desde el año 2001 pasó al Sistema de Tribunales el control de la ejecución de las penas que este dictaba; naciendo así el juez de ejecución en Cuya función se centra nuestro trabajo.
