La Mediación Social: Itinerario Histórico De La Resolución De Conflictos Sociales

Abstract

Este artículo intenta reconstruir el itinerario histórico de la Mediación social en sus diversas modalidades temporales y nacionales, hasta su actual redefinición como proceso profesional de intervención social en la gestión y resolución de conflictos. Para ello propone un primer marco teórico e histórico sobre las distintas manifestaciones mediadoras, delimitando el contenido formal de cada experiencia histórica y de cada concepto teórico: conciliación, arbitraje y mediación. El artículo parte de la visión de Julien Freund sobre “el conflicto como relación social”, y aspira a buscar el denominador común de las formas de actuación y administración ante las relaciones ciudadanas (individuales y colectivas) a lo largo de la historia, para poder reconocer las propias de unas sociedades contemporáneas en constante mutación. Para ello se ilustra a través de tres grandes fases de evolución, caracterizadas genéricamente por sus dimensiones de referencia: tradición, trabajo y ciudadanía. A continuación se sistematizarán tanto los orígenes de la Mediación como disciplina específica en los Estados Unidos, como las realizaciones hechas en Hispanoamérica y Europa. Y finalmente expondremos los distintos campos de actuación de la Mediación, de manera competencial, institucional y normativa, tomado como referente la realidad española, que hacen de la Mediación un campo emergente en el conjunto de las ciencias sociales: familia, menores, derecho penal o conflictos laborales.
