Armonizar entre libre comercio y protección al medio ambiente

Abstract

El Artículo XX del GATT (General Agreemeent on Trade and Tariffs - Acuerdo General sobre Tarifas y Comercio) contiene las excepciones generales al acuerdo, su aplicación ha sido polémica en el sentido de que los tiempos exigen nuevas interpretaciones de viejas normas. Ello en razón a que estas interpretaciones pueden llegar a ser lejanas del texto, así como del espíritu inicial de las excepciones consagradas en un principio. Estas excepciones fueron escritas en respuesta a necesidades e intereses diferentes de los que hoy son esenciales. Dichos intereses tienen que ver en especial con el detrimento ecológico que crece de manera exponencial a escala global. Entender la OMC (Organización Mundial del Comercio) como un mero facilitador del comercio que desconoce otras áreas es inane. Hay asuntos que no están directamente relacionados con el comercio en su propósito prístino (intercambio de bienes y servicios), pero que se ven afectados por el comercio de manera significativa. Para que la OMC se ajuste a los tiempos que corren y a las circunstancias actuales, esos asuntos deben ser tenidos en cuenta. Es pues, necesario asegurar que las normas del comercio -establecidas en el GATT y ejecutables en la OMC- envíen un mensaje positivo al público en términos de los temas de importancia actual, tales como las preocupaciones ecológicas y la defensa de los derechos humanos. La pregunta que este texto busca resolver es si es necesario adaptar viejas reglas a las demandas ambientales, por medio de la interpretación hecha por los Paneles en el sistema de Solución de Disputas de la OMC; o si alternativamente se deben introducir nuevas reglas que sean más claras, específicas y fundamentadas en el problema ambiental. En especial, serán estudiadas y analizadas las raíces del Artículo XX de GATT y el precedente jurisprudencial producido antes y después de la ronda de Uruguay. El objetivo de dicho análisis es descubrir si el Artículo XX realmente ofrece un marco para ventilar el conflicto entre los intereses ambientales y los del libre comercio, o si es una norma obsoleta y lo más conveniente es producir una normatividad más fresca, que tenga como objetivo especifico proveer dicho foro.
