Patinnova 90 - Erste Europäische Konferenz über Strategien zum Patentschutz von Innovationen

Abstract

Am 22./23. Mai 1990 fand in Madrid die erste Europäische Konferenz für Patent und Innovation (Patinnova) statt. Der zunehmend internationale Wettbewerb im Bereich forschungintensiver Produktinnovationen hat in den letzten Jahren viele Unternehmen zu verstärkten Patentaktivitäten veranlaßt. Dies ist aus der Entwicklung der europäischen Patentanmeldungen von 1982 bis 1989 (Tabelle) ersichtlich. Aufgabe einer europäischen Technologiepolitik wird es daher sein, die zweifelsohne wettbewerbsbeschränkende Wirkung des Patents nicht zu Lasten des stimulierenden Innovationswettbewerbs auszudehnen. Das Europäische Patentsystem wird auch künftig seine sichernde und z. T. stimulierende Wirkung auf die Exportaktivitäten größerer und kleinerer Unternehmen ausüben. Im Hinblick auf den EG-Binnenmarkt streben die Unternehmen die rechtliche Absicherung von Marktpositionen durch einen möglichst umfassenden Patentschutz an. Es wurde die Forderung gestellt, diejenigen Elemente des Patent- und Lizenzwesens stärker in den Förderkonzeptionen zu berücksichtigen, von denen eine innovationsstimulierende Wirkung und Anstöße für eine grenzüberschreitende Vermarktung der Forschungsergebnisse erwartet werden können.
