Kreisgröße, Bürgerbeteiligung und Demokratie
Abstract
Die bis zum November 2006 regierende rot-rote Landesregierung in Mecklenburg-Vorpommern hatte eine umfassende innovative Verwaltungs- und Kreisstrukturreform in die Wege geleitet. Im Zuge der Verwaltungsreform sollten Aufgaben vom Land auf die kommunale Ebene verlagert werden und die Kreisstrukturreform sah die Schaffung von fünf Großkreisen vor. Gegen das Gesetzeswerk wurde von Landkreisen, kreisfreien Städten und Landtagsabgeordneten Verfassungsbeschwerde eingereicht. Am 26. Juli 2007 verwarf das Landesverfassungsgericht Mecklenburg-Vorpommern die Kreisstrukturreform als verfassungswidrig, wobei neben Verfahrensfragen insb. die als problematisch betrachtete Größe der neu zu schaffenden Kreise urteilsentscheidend war. Der vorliegende Beitrag beschäftigt sich mit dem Urteil des Landesverfassungsgerichts Mecklenburg-Vorpommern und untersucht die empirische Belastbarkeit zentraler Thesen des Gerichts.Download Info
