Suverenita a nezávislosť štátu - Kosovo

Abstract

Vo svojom článku autor pojednáva o problematike suverenity štátu s akcentom na vnútornú a vonkajšiu suverenitu. Konštatuje, že štát nevzniká na základe vyhlásenia, ale na základe úspešného dovŕšenia efektívneho ovládnutia konkrétneho územia, uznania tejto skutočnosti spoločenstvom štátov a tiež i tým štátom, na území ktorého nový suverén vzniká. Preto vyhlásenie nezávislosti je teda nevyhnutným, nie však dostatočným krokom na ceste k vytvoreniu nového štátu secesiou.
