Právna úprava súdnej spolupráce v civilných veciach v Európskej únii

Abstract

Myšlienku „európskeho právneho priestoru“ (espace judiciaire européen) prvýkrát spropagoval v sedemdesiatych rokoch dvadsiateho storočia vtedajší francúzsky prezident Valèry Giscard d´ Estaing. Táto idea bola vnímaná ako pokus o vytvorenie určitého nástroja v boji s terorizmom v prípadoch, keď jednotlivé európske štáty boli vystavené vydieraniu zo strany blízkovýchodných teroristických skupín. Hoci boj s terorizmom je ešte aj v súčasnosti hlavným motívom tohto projektu, celá agenda je oveľa ambicióznejšia a zahŕňa spoluprácu nielen v trestných, ale aj v civilných veciach. Zámerom tohto článku je charakterizovať súdnu spoluprácu v civilných veciach v Európskej únii.
